02:00 am - Ah yes, the TSA - outcome from Ron Paul's detained Aid
http://www.aero-news.net/index.cfm?ContentBlockID=615e45f8-4a6e-4e58-a2d7-84971d404419

Gee... no mention of this in the MSM... fishing expeditions or no. My sadly fav part, "The second directive says "traveling with large amounts of cash is not illegal." However, TSA said it would not release copies of the directives without a Freedom of Information request."

FOI is necessary to determine if my personal property beyond x oz. toothpaste can travel?*^%$@ What an absolute crock.

06:45 pm - Get rid of roaches with Arbor Mist
I swear, the roaches in my apartment are immune to borax and boric acid- I've sugar-coated them and watched them walk around for HOURS without issues. So much for THAT method. And I've put tons of those roach bait traps around, and I've never seen a roach go near one. Ever. Fail on that one. I have cats, and I've had cats die before after pest control sprayed for bugs, so I'm a little leery of going the liquid chemical route. Our landlord refuses to hire someone to do it anyways.

I don't have a job, so I've got nothing to do but clean and blog. Guess what I do a lot of. Yep- cleaning. I'd say the place is not the most habitable to roaches. However, they're living in the walls and I suspect festering in the neighbours' apartment, coming in through the hole in the shared wall by the oven. They're everywhere, and I was FED UP.

Then I discovered something. I was taking a break from laundry and poured myself some deliciously cold champagne. Drank almost all of it, left a little in the bottom of the mug (no, I'm not going to bother with proper champagne glasses mid-day. Mugs I can put in the dishwasher!) Forgot about it and left it on the counter while cleaning the bedroom. Came back hours later. Check glass. Dead roaches floating in it. A lot of them.

AHA!

Sugary liquids draw them like mad- crappy $5 Arbor Mist strawberry wine has more than enough sugars to draw them. And because of the alcohol content, they drown and die off! w00t! All you need is a 25 cent thrift store mug and a bottle of Arbor Mist, or something similarly sweet and cheap. I recommend getting a small cup different from any other you own strictly for this purpose, and make sure it's small so that smaller roaches have no trouble climbing it and finding the alcohol. I used a small teacup and about 1/8c of sweet wine each time. I let it sit out for a day or two before rinsing it out and pouring a new glass. So far, I think I've killed about 30 roaches today, not counting the ones I killed without the alcohol.

Alcohol FTW.

02:31 am - Russian lawyer is seeking for several bankruptcy courts' decisions: help in research needed
Hello,

I'm writing an article on the doctrine of substantive consolidation in american bankruptcy and I can't find several decisions. Honestly speaking i even don't have any idea where i can find documents with such entries as “89 B.R. 832 (Bankr. C.D. Cal. 1988)” or smth like that. Google doesn't help =(

I’ll be grateful for any advice on where I can find such decisions over internet. The list of the decisions I’m looking for:

In re Vecco Constr. Indus., Inc., 4 B.R. 407, 409 (Bankr. E.D. Va. 1980)
In re Richton Int’l Corp., 12 B.R. 555, 557 (Bankr. S.D.N.Y. 1981)
In re Food Fair, Inc., B.R. 123, 126 (Bankr. S.D.N.Y. 1981)
In re F.A. Potts&Co., Inc 23 B.R. 659, 574 (Bankr. E.D. Pa. 1982)
In re Parkway Calabasas, 89 B.R. 832 (Bankr. C.D. Cal. 1988)
In re Murray Industries, Inc., 119 B.R. at 822 (Bankr. M.D. Fla. 1990)
In re Stone & Webster, Inc., 286 B.R. 532, 538 (Bankr. D. Del. 2002)
Simon v. Brentwood Tavern, LLC (In re Brentwood Golf Club, LLC) 329 B.R. 802, 811 (Bankr E.E. Mich. 2005)

And also I can’t find two old decisions (though as I understand they’re not extremely important for the topic):
Fish v. East, 114 F.2d 177 (10th Cir. 1940)
Stone v. Eacho, 127 F.2d 284, 290 (4th Cir. 1942)

Also I’d like to discuss the modern development of the doctrine. I'm especially interested in 2 questions: implementation of In re Owens Corning test (has it been accepted by courts in other circuits? And that’s about so called liberal trend now?) and securitization and substantive consolidation (has someone successfully used the doctrine in a bankruptcy case involving an originator and its SPV to avoid the SPV’s bankruptcy remoteness during this crisis?)

04:12 pm - New Treatment in the U.S. for Heavy Menstrual Bleeding
Hi [info]birthcontrol:

This isn't exactly birth control news, but it is indirectly and it's important enough for some of you that we wanted to bring it to your attention.

The FDA just approved the first non-hormonal treatment for heavy menstrual bleeding: a medication called Lysteda (I want the job of the guy who names new prescription medication. )

Here's the 411:

The U.S. Food and Drug Administration today approved Lysteda tablets (tranexamic acid), the first non-hormonal product cleared to treat heavy menstrual bleeding (menorrhagia). Lysteda works by stabilizing a protein that helps blood to clot.

Heavy menstrual bleeding is reported each year by about 3 million U.S. women of reproductive age. Women with uterine fibroids may experience heavy menstrual periods. But in most cases, there is no underlying health condition associated with the condition.

“Menorrhagia can be incapacitating for some women,” said Kathleen Uhl, M.D., FDA’s associate commissioner of women’s health. “Heavy menstrual periods can cause pain, mood swings, and disruptions to work and family life.”

Tranexamic acid was first approved by the FDA in 1986 as an injection, under the brand name Cyklokapron, and is used to reduce or prevent bleeding during and following tooth extraction in patients with hemophilia, a hereditary bleeding disorder caused by the lack of a blood clotting factor.

The most common adverse reactions reported during clinical trials by patients using Lysteda included headache, sinus and nasal symptoms, back pain, abdominal pain, muscle and joint pain, muscle cramps, anemia, and fatigue. There was a statistically significant reduction in menstrual blood loss in women who received Lysteda, compared with those taking an inactive pill (placebo).

Use of Lysteda while taking hormonal contraceptives may increase the risk of blood clots, stroke, or heart attack, according to Scott Monroe, M.D., director of the Division of Reproductive and Urologic Products in the FDA’s Center for Drug Evaluation and Research. Women using hormonal contraception should take Lysteda only if there is a strong medical need, and if the benefit of treatment will outweigh the potential increased risk.

If this is something you experience, talk to your doctor and see what your options are. We hope this is helpful for some of you!

Have a spectacular weekend!

08:56 am - Unpaid Internships
This article popped up through a government small business mailing list I'm on.

Thought it might be helpful for students to have an idea of what they should expect from an unpaid internship:
http://community2.business.gov/t5/Business-Law-Advisor/The-Truth-Behind-Unpaid-Internships/ba-p/9340#A270?cm_mmc=GovDelivery-_-111209-_-weekly-_-community

Or a paid internship:
http://www.dol.gov/whd/forms/fts_wh205.htm

Knowing the law behind something can help you spot whether or not it's hinky. Internships are a really great way to gain some experience and get your foot in the door...particularly in certain industries. You just want to make sure that you're not being abused in the process.

I'm an English Lit major, and my original plan is to graduate with the Honors program. If I want to do this, I need to take just about four more classes than is required for the major, graduate with a B+ average and get an A on my thesis. I can do that.... or I can just be a regular major, without the Honors.

The only reason why I would want to pursue with the Honors program is because I have a feeling it would look good on a job resume (for what kind of job, I have no idea). Otherwise, I wouldn't bother. I'm just two classes away from finishing the major and I'm so tempted to say... fuck it!

I'm just wondering who has had experience pursuing an Honors degree in English Lit, and if you think it really matters to your employer regular you're an Honors student or a regular ol' English major?

http://blogs.usatoday.com/gameon/2009/11/new-mexico-womens-soccer-player-elizabeth-lambert-suspended-for-physical-play-vs-byu.html

All the excessive media reports on this woman has made me feeling very angry, appalled, insulted, and aggravated with what is still considered to be a taboo gesture of a specific individual because of her gender. (How dare America dictate to anybody on how to run their sovereign nation when we can't even run our own without a little bit of bigotry, sexism, and marginalization of specific groups of people because they do not allow themselves to be conformed to a biased, discriminatory, despicable patriarchal, society which sometimes places themselves on a moral pedestal when another country happens to do the same thing albeit in a more blatant way.)

So a soccer player gets physical with a member of that soccer player's opposing team, alert the Newspapers and the firing-squad because she happens to be a *gasps*..wait for it... wait for it... a woman!

Guess all the animals are gonna be masturbating and salivating tonight, and the sad thing is, nobody sees anything at all wrong with this picture. Its a very sad thing.

12:31 pm - Who Are Those People?
I had never encountered the word 'classism' until I was attacked by liberals on the internet for expressing certain opinions. Here are a few examples of strange arguments I've heard:

1.) Somali pirates are poor farmers and fishermen who have been exploited by western civilization. Pirating is the only way they can gain income to feed their families. Shame on you for complaining.

2.) Parents who feed their children carbonated beverages and processed junk are often unable to afford fresh fruit and milk. It's classist to suggest we could halt the obesity and diabetes epidemic by feeding our children nutricious foods.

Apparently a 'classist' is a person who is prejudiced against 'those people'. Who are those people? Are they the poor, lower-class, misused, underpriviledged, uneducated, downtrodden members of society who, because of their wretched condition, are not to be held accoutable for their actions, therefore are beyond reproach? I often hear liberals throw around that classism word, accusing us of being intolerant because we complain about piracy and irresponsible behaviour, yet they are allowed to act elitest and classist toward the following:

-Backwards hicks from rural areas.
-Pundits who do not have the pedigree of William F. Buckley.
-Politicians who didn't graduate from an Ivy League University.
-Regular working-class people who do not consider themselves intellectuals.

Also, isn't it classist to criticise regular people for owning gas-guzzling SUVs, yet not complain about Al Gore for living in a resource draining mansion? What do you think? I apologize if this entry isn't as organized as I would have liked. It was kind of spur of the moment.

10:34 am - Why Antidepressants Don't Work

"The majority of people who take antidepressants for depression never get relief. Why? Because the cause of depression has been oversimplified, and drugs designed to treat it aim at the wrong target, according to a new study that appears to topple some strongly held beliefs about depression. "

continued...

While not everyone likes Mercola, I find the study insightful. I wonder where it will lead them from here.

10:10 am - Contract ?
Hello all...

Friendly question. Back in September I signed a contract worth about 10k to have a bunch of windows replaced in my house. The contract included the stipulation that the contractor would obtain all necessary building permits.

When the guy came out to measure the windows (but after the contract was signed) my husband mentioned we were in a historic neighborhood. They had a discussion, the guy said it might make pulling the permits a pain, and was a little concerned but hubby seemed to think they'd take care of it.

Well, they ordered the windows and then went to pull the permit. The exact words of the guy to me were "boy we wish we'd known you were in a historic neighborhood before we ordered" (which, per my husband, they DID). The city's just dragged their heels on it. At this point we've written a couple appeals, and still have no permit. This is probably related to the fact that it's a historic district and the city hates to see anything replaced.

Unfortunately, I don't have anything that documents to them that we're in a historic neighborhood, just the conversation when the guy came to measure windows. We've already put down half, and the windows are sitting in the contractor's lot waiting to be installed.

What are my rights if they city won't issue a permit to install the windows?

How did this happen? The thought and discourse has been so cheapened. So many conservatives have become populist ideologues without ideas. Is the convenience of Fox (contemporary muckrakers, yes, perverse) and other organizations bringing down the quality of discourse?

p.s. I am not a liberal and this is not really a troll. I am just trying to get some qualitative answers about some questions that have been bothering me. I will go away soon.

08:31 pm - Climate Fools Day
So far I haven't seen any news that "Warmers" like Greenpeace, the IPCC, or anyone else showed up Oct 28 to answer Piers Corbyn's challenge to provide "scientific observational evidence" that CO2 changes drive world temperature or climate change.

- Score one for the "Heretics", as the Oct 24 "international day of climate action" sponsored by 350.org was a total bust--only a few people attended this event. Locally only 40 came, while a similar event two years ago attracted 120 people.

EDIT:Just so everyone knows.. the non-profit which I picked for the 5% to be donated back to is Teach for America like I did this summer. Also, this started on Thursday, but the post was not approved until last night? You still have through Sunday.

I'm looking for advice from people that have had their child support payments reduced. My boyfriend is currently paying out 25% of his income to a child he isn't even allowed to see (for NO good reason!).

How did you go about doing it?
Did you need a lawyer?
How long did it take?
Was it successful? (I've heard it doesn't always work out for the better.)

Anything other advise you can offer up?

Right now i'm eating curry rice, with a hot dog chopped up in it. :( I'm moving soon and I refuse to go grocery shopping until I eat all the food I have, so nothing goes to waste.

I was just wondering what strange food combinations you guys have eaten when you were low on money and only eating things that were already in your pantry!

07:22 pm - How can I keep my mom alive and get her the medical help she will die without?
This is a matter of life and death, and I wish I was kidding.

My mom has a very large tumor in her chest, and we can't do anything about it. It's bad enough that she's in the hospital through the ER every 2 to 4 weeks, and they said it needs to be taken out. Her last ER/hosp trip they found out the tumor has a tumor growing on it now. It's not cancerous, so if they can get it out, she'll have a recovery period the doctors estimate for 6 weeks, and then she'll be okay. Left alone, it's expected to kill her within months. We've been dealing with this for a year, with the first tumor diagnosed in March. The county where she lives has a very small, inadequate hospital that doesn't have the equipment or any doctors with the skills to remove this particular tumor. The hospital that's nearest that can is in another county. She can't get in the doors of that other hospital without insurance or Medi-Cal. She tried once by ambulance, and was transferred back to the small hospital 100 miles away after being stabilized.

The doctors had her apply for disability since she can't work, and she was denied. An attorney took it on on contingency, but today she got a decision on the court appeal and the court denied it. So she gets nothing. The social security office says she's well enough to be working full time, and the judge sided with them even her doctors, the ones who are professional, and her medical history since last summer show she can't. How can someone work when about a third of her time is spent hospitalized with the doctors struggling to stabilize her so she doesn't die and can live another week?

What she has now is a county coverage that only covers doctors in her county. No where else. The doctors she's seeing have tried getting her in the doors at the larger hospital, but can't.

She's under 65, not considered disabled even though she really is, isn't pregnant, or anything else, so she doesn't qualify for Medi-Cal or Medicare. She also has been turned down for private insurance. If she was accepted anyway, we don't know how the premium would have been paid since I'm not floating with extra dollars either, but I'd find a way. But she was denied anyway so it doesn't matter. I've applied for her for every medical insurance company in the northern California region.

She lives in Merced County right now, and the hospital she needs to be in is in San Mateo County, if this makes a difference at all. She worked until she not too sick last summer, a nurse for 25 years who now can't get medical help and will die, the doctors are surprised she hasn't died yet but she's close. It's really dire. She's wasting away from her organs shutting down from these tumors. On a "good" day, her weight goes up to 95 pounds, which is too little for 5'5".

What are some options for us/her, or do we have to accept she's just going to have to die?

Some suggestions made we'll try
Contacting congressmen
Trying the media, already submitted to Good Morning America on someone's suggestion
Trying Fresno's Community Memorial, and I now have some calls in waiting to hear back

I've given more information that I feel comfortable with, like my mom's location and occupation, and the hospital that can treat her and won't, hospitals she's been to, and why her disability claims were denied, even though it makes no sense how the court thinks she can work when her doctors say she can't. I know this is a new journal. I found this place by a google search for poor people and medical help. We exhausted every option we could think of on our own and from suggestions of people we know, and brick wall after brick wall is why I decided to ask publicly and online in case anyone had ideas no one we know thought of.

No one questions the cases in the media when a cancer patient is dying and can't get medical care no matter how hard they try, but I've been called a liar in the comments because my mom's sotry is just as dire. I don't care if anyone thinks that. If I can get a suggestion that works and saved her life, then what does it really matter is a few strangers think I'm lying? It's desperation that's even made me come online to ask for ideas. I wish this was all something made up. No one should die because they don't have money. But cancer patients die from not having any, and who says they're lying? People die all the time from not being able to get medical care. Getting aid requires more than being poor and having no assets. If that's all it took, don't you think every poor adult out there would have government coverage? Wouldn't you all have coverage if you only had to be poor and own very little?

My mom has no money or assets, and I'm living at the povery level, and we both eat from food kitchens and pantries. I send all money I can to help her. That's what being poor is. It's not having enough or a lot. if we had the money to pay for this, we wouldn't be poor. So just give suggestions. That's all I'm asking for, and they're free to give.

10:51 pm - Packing Lunches for Grown-Ups!
I really have tried looking, so I thought I'd seek input.

I'm finally moving in with my husband, after being forced to shell out 950 dollars a month in room and board on campus for the time up until our marriage. The agreement with him is that I pay for and prepare all foods, something he's not exactly the greatest at (and has been living on fast food). As we all know here, fast food is very expensive, especially when the costs start to add up.

Since neither of us will be at home at one set time for lunch, packing seems like the best option. We both will have access to microwave and refrigerating facilities.

So, what makes a good, cheap, packed lunch for someone older than 10? And please don't suggest lunch meat sandwiches unless you have a tip on making them cheaper, lunch meat is actually surprisingly expensive compared to the costs of most any kind of meat, and it's a pretty obvious option anyway.

So, share with us your recipes, any interesting links, any ideas, any suggestions, anything related to the process of lunch packing! Heck, I'll even take suggestions for things that reheat well.
